FedEx Class Action Lawsuit Alleges FedEx Improperly Classified FedEx Employees as Independent Contractors

Several class action lawsuits have been filed across the country because of FedEx's alleged practice of misclassifying employees as independent contractors.

FedEx drivers have alleged that FedEx classifies them as independent contractors so that FedEx does not have to pay for its trucks, insurance, fuel, maintenance, and the like.  FedEx drivers have alleged that they are employees and not independent contractors and should be legally treated like employees, including having the benefits of being an employee as opposed to an independent contractor.

At least one court has found that due to the level of control FedEx has over its drivers, FedEx drivers are employees -- not independent contractors.  As employees, FedEx drivers should have the right to receive the benefits of being an employee.
